Levin: McConnell Can Declare Impeachment 'Null and Void' Because Pelosi Failed To Transmit Articles

Talk show host and former top Reagan Justice Department official Mark Levin called on Senate Majority Leader Mitch McConnell to declare the House impeachment of President Donald Trump “null and void” because House Speaker Nancy Pelosi failed to transmit the articles to the Senate.

Similarly, Harvard Law School professor emeritus Alan Dershowitz argued in a Thursday Op-Ed that a failure to send the articles of impeachment to the Senate would rob Trump of his constitutional rights.

 

“Here’s what Mitch McConnell and the Senate Republicans must do in response: The Senate has the sole power under the Constitution to adjudicate an impeachment. Therefore, Pelosi is attempting to obstruct the Senate’s power to act on its constitutional authority,” the Fox News host continued.

My guess is Pelosi submits the articles. Dems last gasp is "We impeached Trump". They did. If the articles are not forwarded it is going to be difficult for dems to justify what they put the nation through. The dems have no evidence and the Senate is going to acquit. The dems will claim the trial was unfair as posters here complain about McConnell. The trial will be fair as dem. Senate candidates for president have already said they will vote for removal before the reviewing the evidence at trial. Pelosi surprised the nation by not submitting. She knows that she has no influence on what the rules in the Senate will be. Pelosi will have to stand on the fact that the House impeached with no evidence of any crime. Not submitting gives the dems a few weeks to devise their strategies. Not submitting will be the final nail in the coffin for the dems.

The United States Supreme Court ruled in Nixon v. United States (1993): 

"the three very specific requirements that the Constitution does impose on the Senate when trying impeachments : The Members must be under oath, a two-thirds vote is required to convict, and the Chief Justice presides when the President is tried. These limitations are quite precise, and their nature suggests that the Framers did not intend to impose additional limitations on the form of the Senate proceedings" (emphasis added) 

Ergo, if Mad Nan chooses not to 'formally deliver' the articles of impeachment and/or to not send 'managers' to present the House's case, the Senate is well within its Constitutional authority to proceed without them.
