the National Firearms Act of 1934.

This law infringes upon the second amendment of the United States Constitution which reads:

“A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed."

Which is why no intelligent discussion is in any danger of happening in NHB except by more Liberal minded posters.

 

At this point I would suggest all users go to the Liberals only room, and leave NHB to become a right wing troll circle jerk that gets no posters.

 

Maybe then will someone with actual leadership abilities take over and create a usable forum.

 

This way we know where all of the right wing trolls are, and take away any reason they have to participate.

You do have the ability to put anyone on ignore, real easy to do. I have three troll cons on ignore and it has done wonders for my health, you don not see their posts and you don't have to scroll past miles of their graffiti.

 

Click on your name in upper right corner.

enter posters name in box, and check Ignore: Posts Signature Messages

Then click OK and you are on your way to a good experience at NHB

But even though the 5-4 majority ruling makes an intellectual end run around the language of the Second Amendment to get to their ruling, they very clearly state that society (government, convened to collectively protect us from what we can’t protect ourselves from as individuals) has the right to, and legitimate interest in controlling gun ownership, in several specific ways.

On pp. 54 and 55, the majority opinion, written by conservative bastion Justice Antonin Scalia, states:

“Like most rights, the right secured by the Second Amendment is not unlimited…”.
It is
“…not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose.”

Nothing in our opinion should be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms.”

“We also recognize another important limitation on the right to keep and carry arms.
Miller
(an earlier case) said, as we have explained, that the sorts of weapons protected were those “in common use at the time”. We think that limitation is fairly supported by the historical tradition of prohibiting the carrying of ‘dangerous and unusual weapons.’ ”

The court even recognizes a long-standing judicial precedent
“…to consider… prohibitions on carrying concealed weapons.”

What part of well regulated don't some people understand? Does not regulate mean to supervise or control using rules and regulations. Just saying.

 

 

That was the basis of Scalias opinion in the Heller ruling. While it was a 5-4 decision, leaving it open to further interpretation in the future, the opinion was quite clear. There are no absolute 2nd Amendment rights. The states have an equal right under the 10th Amendment to pass restrictions as spelled out in the opinion. Trumps election will actually cause more states to enact further restrictions on guns, and states such as California and New York will pass even more restrictive measures, like those just passed in Oregon and Washington.
