Rachel Maddow brought up an interesting point the other day......

 

If this election ended in a virtual tie as Bush/Gore did, and it eventually went to the SCOTUS to be decided

as it did then and ended up in a tie 4-4 there now , what would happen then ???

If the Electoral College ends up a tie, the Presidential election is decided by the House of Representatives, with each state delegation having one vote. Twenty-six votes are needed to win. The Senators elect the VP, with each Senator having one vote. Again, 26 votes is needed to win. This doesn't go to the Supreme Court to decide who wins ... only who gets the electoral votes if there's a challenge to the voting process. If there were, and the Supreme Court ended up a tie, then the vote would stand as is, with whoever had the greater electoral vote becoming President.

Trump just tied a noose around his neck today.... well his behavior from 10 years ago did...and its coming back to haunt him.

Trump was only voicing Bill Clinton's thoughts, es. You know that. And Hillary believes that too. She believes that it applies not only to women but to ANYONE ... when your famous like her. She sure has acted like she can F all of us over with total impunity. At least with Trump we can impeach him should he turn out to be as bad as you folks claim. Hillary? We'll be stuck with her ... even if she starts taking away things that you leftists like or want. She's demonstrated that she's that impervious to the law now. That should trouble everyone. THAT alone should be sufficient reason to make sure that she never sets foot in the Oval Office again.

Although it was first addressed by Article II, if there were a tie in the Electoral College we would follow the process outlined in the 12th Amendment (ratified in 1804): “the House of Representatives shall choose immediately, by ballot, the President” and “the Senate shall choose the Vice-President.”

 

The catch is that the votes in the House aren’t tallied by each representative: “the votes shall be taken by states, the representation from each state having one vote.” That means that all the representatives within a given state vote as a bloc, and each state has one vote. The majority of votes within that state bloc determine its vote.

 

The votes in the Senate are cast by the individual senators.

 

That also means that with an even 50 votes in the House and 50 in the Senate (D.C. doesn’t get a vote), there is potential for yet another tie vote. But the 12th Amendment covers that too: “if the House of Representatives shall not choose a President whenever the right of choice shall devolve upon them, before the fourth day of March next following, then the Vice-President shall act as President, as in case of the death or other constitutional disability of the President.” This section was later superseded by the 20th Amendment, which moved the start of the new session of Congress from March to early January.

 

If the Senate is unable to break a tie for the vice president, according to the Presidential Succession Act of 1947, the speaker of the House serves as acting president.

 

Electors officially cast their votes in December, and the electoral votes are tallied in a joint session of Congress in January.

No doubt it would be a mess, especially if the Supreme Court also got involved in some way.

The country is not going accept Trump deflecting away from his deplorable behavior.
