The Senate ethics panel should take a long look

In a just world, no politician would leave office wealthier than on the day he takes the oath of office. We don’t live in a just world, alas, and the rags-to-riches life stories of more than a few U.S. senators strain credulity.

Senate Majority Leader Harry Reid, once an officer of the Capitol Police, joined the ranks of multimillionaires during his four decades on the public payroll. He says he’s a good investor, and no doubt he is, but the watchdog group Cause of Action wants the Senate Ethics Committee to inquire as to whether and how he used his office to pad his campaign war chest.

 

The Senate’s code of conduct stipulates that a senator may not “permit any compensation to accrue to his beneficial interest” as a result of “influence improperly exerted from his position.” It prohibits petitioning executive branch agencies for financial benefit for the benefit of immediate family.

 

Cause of Action accuses Mr. Reid of attempting to influence the Obama administration to overrule career bureaucrats at the Department of Homeland Security to “expedite” visa applications for nearly two-dozen foreign nationals who were investors in a Nevada casino. Mr. Reid’s son, Rory, was a lawyer for the casino.

 

The facts are clear enough. Career officials at the Department of Homeland Security turned down an expedited EB-5 visa application by the SLS Hotel & Casino in 2012 because agents were concerned over “suspicious financial activity.” Mr. Reid called Alejandro Mayorkas, who was then the director of the U.S. Citizenship and Immigration Services, to ask him to reverse the decision. Mr. Mayorkas cheerfully obliged.

 

Mr. Reid then changed Senate rules so that Mr. Mayorkas could be promoted to the No. 2 position at the Department of Homeland Security, even though he was the subject of an investigation by the inspector general.

In a letter to the ethics committee, citing an investigation by this newspaper, Daniel Z. Epstein, the executive director of Cause of Action, said, “the American people deserve better. It is unfair for politicians to attempt to influence the enforcement of our laws, especially when they — or their close family members — stand to benefit.”

The EB-5 visa program grants temporary or permanent residence to foreigners who invest in a business in the United States. The program has tripled in size under Mr. Obama and essentially sells U.S. citizenship to the highest bidder. The scheme invites corruption.

 

Mr. Reid has a long history of scratching the backs of his friends. Green-energy companies that donated to Mr. Reid, including BrightSource Energy, Nevada Geothermal, Ormat Nevada and Solar Reserve, were then showered with taxpayer dollars.

 

Allegations of corruption in these cases are easily brushed aside since these companies are saving the planet by lowering the Earth’s temperature. (Anyone who braves the below-zero wind chill to inspect the snowy landscape this week might say they’ve gone too far.) Mr. Reid’s intervention in this casino caper will be difficult for him to explain. It ought to be even more difficult for the Senate to ignore.

rory was so ashamed of his dad's baggage, when he ran for GOVERNOR he refused to use his last name,

it was no where on his website, until the end after people made so much fun of him about it..

Harvey Whittemore Convicted Of Making Illegal Campaign Contributions To Harry Reid

 

RENO, Nev. — A Nevada powerbroker who headed a billion-dollar real estate company and pulled the strings of state politics as a prominent lobbyist for more than a decade was convicted Wednesday of making illegal campaign contributions to U.S. Sen. Harry Reid.

 

Harvey Whittemore, 59, could face up to 15 years in prison and hundreds of thousands of dollars in fines after a federal jury returned guilty verdicts on three counts tied to nearly $150,000 illegally funneled to Reid's re-election campaign in 2007.

 

Later in the day, U.S. District Judge Larry Hicks declared a mistrial on a count of lying to the FBI after jurors said they were deadlocked on that charge.

 

Whittemore stood with his arms behind his back and shook his head slightly after the verdicts were read. He was convicted of making excessive campaign contributions, making contributions in the name of another and causing a false statement to be made to the Federal Election Commission.

 

Each count carries a maximum penalty of up to five years in prison and a $250,000 fine. The judge set sentencing for Sept. 23.

 

Assistant U.S. Attorney Steven Myhre said prosecutors will review the case before deciding whether to refile the charge of lying to the FBI during a February 2012 interview.

 

Dominic Gentile, Whittemore's lead defense counsel, said the convictions will be appealed to the 9th U.S. Circuit of Appeals. He said a case pending before the U.S. Supreme Court touches on similar issues related to the constitutionality of federal limits on campaign contributions.

Nevada's law banning cash bonuses for voter registrations has been upheld by that state’s supreme court despite an ACORN-backed legal challenge to its constitutionality.

 

The decision upholds the 2011 criminal conviction of former senior ACORN executive Amy Adele Busefink for her role in a massive voter fraud conspiracy. Voter fraud, sometimes called vote fraud, election fraud, or electoral fraud, is a catch-all phrase coined by lawyers that encompasses a host of election-related improprieties.

 

As I reported in my book, Subversion Inc., at least 54 individuals associated with ACORN have been convicted of voter fraud. (Table of convictions available here.)

 

ACORN itself was convicted of voter fraud in Nevada last year in a case that arose out of the same set of facts as in the Busefink case.

 

Las Vegas Judge Donald Mosley said the actions of ACORN made “a mockery of our election process.” Mosley called ACORN’s crime “reprehensible” and said it was “the kind of thing you see in some banana republic, Uruguay or someplace, not in the United States.”

 

The case involved a conspiracy to provide illegal financial bonuses to voter registration canvassers for exceeding their daily quotas. Nevada law forbids the practice on the theory that such bonuses provide an incentive for canvassers to file bogus registrations.

 

The court found that the Nevada statute “neither violates the First Amendment nor is unconstitutionally vague.” Busefink argued unsuccessfully on appeal that Nevada’s ban on “the payment of individuals based upon the number of voters registered” violated her free speech rights.

 

This resounding affirmation of Nevada's voter fraud law comes as photo ID laws nationwide come under attack by left-wing activists and their black-robed brethren. Many of the legal attacks on these electoral integrity laws are funded by Obama backer George Soros. Soros-funded advocacy groups Media Matters for America and the Center for American Progress have been working nonstop to undermine public support for common sense legislation promoting clean, honest elections.

 

Busefink was found guilty last year after making a plea deal regarding two gross misdemeanor counts of conspiracy to commit the crime of compensation for registration of voters. A gross misdemeanor is a crime that is more serious than a misdemeanor but less serious than a felony.

 

Busefink was sentenced to two years imprisonment but the jail time was suspended. She was also fined a total of $4,000 and ordered to perform 100 hours of community service. Prosecutors had argued for a fine of just $1,000.

 

The criminal complaint filed against Busefink by the Democratic attorney general of Nevada, Catherine Cortez Masto, in May 2009 stated that as “ACORN Regional Director for Voter Registration” Busefink “did aid, abet, counsel, encourage, hire, command, induce or procure ACORN to commit the crime of Compensation for Registration of Voters” by approving a bonus program called “Blackjack” or “21.” Voter registration canvassers were given cash bonuses for exceeding a daily quota of 20 registrations.

 

This wasn’t the first time Busefink was involved in shady electoral dealings. Even while under indictment in Nevada she ran the 2010 national voter drive for Project Vote.

 

Busefink also ran the disastrous joint ACORN/Project Vote voter registration drive of 2008. In that campaign, officials chucked an astounding 400,000 bogus voter registrations.

 

Project Vote is the unit of ACORN that Barack Obama worked for in 1992 when he led a successful get-out-the-vote effort that helped to make him a star in the left-wing activist community. Project Vote and ACORN have long been indistinguishable. Until recently Project Vote operated out of ACORN’s offices in Washington, D.C.

 

Busefink still works for Project Vote as its field director. (Project Vote filed a friend-of-the-court brief in her appeal in Nevada.)

 

ACORN Inc., the lead entity that controlled the ACORN network of activist groups, filed for bankruptcy on Election Day 2010.

 

Across the country state chapters of ACORN, which stands for Association of Community Organizations for Reform Now, have been incorporating themselves separately in order to carry on ACORN’s work.

18 Former ACORN Workers Have Been Convicted or Admitted Guilt in Election Fraud

The scandal-plagued ACORN may no longer exist, but its tarnished legacy lives on in court, as the activist group and its former employees face criminal punishment.

 

So far this year, at least 18 former workers have admitted guilt or been convicted on varying charges of election fraud. The punishment has ranged from probation to several months of prison time.

 

ACORN, once a powerful advocate for low-income and minority voters, shuttered its operations amid plummeting revenues in March, six months after conservative activists posing as a pimp and prostitute caught on video some of the group's employees offering them tax advice.

 

But the group is still facing charges in Nevada on conspiracy to commit the crime of compensation for registration of voters.The trial, originally scheduled to begin Monday, has been postponed likely until next year.

 

Former workers across the country already are being punished for their criminal activities.

 

In Miami, seven former ACORN voter registration canvassers were convicted of "false swearing-in an election," and sentenced to probation and community service and banned from participating in future political campaigns, according to court documents.

 

In Pennsylvania, six of seven former ACORN workers who were charged in an investigation were convicted of unsworn falsification and interference with election officials. Four have reached a plea agreement on reduced charges and will serve two years of probation. Cases against two others who entered pleas to reduced charges are pending.

 

Charges against the seventh, Eric Jordan, are not being prosecuted because Jordan has pleaded guilty to much more serious charges, including aggravated assault, resisting arrest and carrying firearms without a license.

 

In Milwaukee, three former ACORN workers have been convicted of election fraud.

 

Last week, Kevin Clancy was sentenced to 10 months in prison for his role in submitting falsified voter registration forms before the 2008 election. Clancy will start his sentence once he finishes another sentence he is currently serving for armed robbery.

 

Clancy's co-worker, Maria Miles, who pleaded guilty to election fraud in August, will be sentenced on Dec. 6.

 

In September, Frank Walton pleaded guilty to submitting 54 fake voter registrations during the 2008 presidential campaign. He faces up to 42 months in prison and a $10,000 fine when he's sentenced Dec. 6.

 

In Washington state, Kendra Lynn Thill was convicted in March of voter registration fraud in the 2006 midterm election. In Nevada, a former ACORN supervisor pleaded the equivalent of a no-contest in a case alleging that canvassers were illegally paid to register voters during the 2008 campaign. But while Amy Busefink's plea acknowledges the state had evidence for a conviction at trial, her lawyer said she still plans to challenge the constitutionality of the state law prohibiting paying canvassers based on the number of voter registration forms they turn in.

Reid has really helped mining interests and the casino industry in Nevada, which is all Nevada has to offer the world.So in that sense, he represents Nevada quite well.

 

As Senate Majority Leader, he has done his job, and does not cave in to the evil Rethugs, like Maobama does.

Project Vote is the unit of ACORN that Barack Obama worked for in 1992 when he led a successful get-out-the-vote effort that helped to make him a star in the left-wing activist community. Project Vote and ACORN have long been indistinguishable. Until recently Project Vote operated out of ACORN’s offices in Washington, D.C.
